Jeżeli wnioskowałeś o wsparcie w ramach „Tarczy Finansowej PFR”, sprawdź jakie dokumenty jesteś zobowiązany dostarczyć do Banku.

Zgodnie z Regulaminem ubiegania się o udział w programie rządowym „Tarcza Finansowa Polskiego Funduszu Rozwoju dla małych i średnich firm”, przedsiębiorca zobowiązany jest dostarczyć do Banku dodatkowe dokumenty.

Zobowiązany jest dostarczyć je do Banku nie później niż do dnia 31 grudnia 2020 r.:

  • dokument potwierdzający, że osoba składająca Wniosek była umocowana do złożenia Wniosku oraz akceptacji i zawarcia umowy subwencji finansowej. W przypadku, gdy wniosek został złożony przez osobę nieupoważnioną do samodzielnego składania woli w imieniu przedsiębiorcy – pełnomocnictwo.
  • Oświadczenie Beneficjenta o potwierdzeniu i akceptacji treści i należytego zawarcia Umowy Subwencji Finansowej.

Dodatkowe informacje:

  • Pełnomocnictwo nie może być wystawione post-factum. Pełnomocnictwo powinno być co najmniej z daty złożenia wniosku o subwencję i nie powinno być
    datowane później.
  • Przedsiębiorca powinien złożyć do Banku pełnomocnictwo w przypadku złożenia wniosku przez:
    • spółkę cywilną – zawarcie umowy o subwencję finansową jest czynnością przekraczającą zwykły zarząd spółki cywilnej i powinna być zgoda/pełnomocnictwo drugiego wspólnika, albo potwierdzenie przez niego czynności – nawet jeżeli z umowy spółki cywilnej wynika, że do reprezentowania i zaciągania zobowiązań w imieniu spółki upoważniony jest jeden ze wspólników;
    • podmiot wpisany do rejestru przedsiębiorców KRS, gdy z KRS wynika, że do reprezentowania i zaciągania zobowiązań w imieniu spółki wymagane są dwa lub więcej podpisów;
    • osobę fizyczną prowadzącą działalność gospodarczą – w przypadku, gdy wniosek o subwencję oraz umowa subwencji została podpisana za klienta przez osobę nieupoważnioną do samodzielnego składania woli w imieniu klienta.

Polski Fundusz Rozwoju wymaga, by pełnomocnictwo udzielone osobie, która złożyła Wniosek lub zawarła umowę subwencji finansowej w imieniu klienta oraz Oświadczenie Beneficjenta zostały podpisane wyłącznie przez osoby upoważnione do reprezentacji klienta, których dane ujawnione są w odpisie z Krajowego Rejestru Sądowego lub Centralnej Ewidencji i Informacji o Działalności Gospodarczej i dostarczone do Banku wyłącznie za pomocą kwalifikowanych podpisów elektronicznych lub w formie pisemnej z podpisami notarialnie poświadczonymi.
