Wniosek o subwencję z Tarczy Finansowej – trzeba wpisać dane z deklaracji VAT

Problem przedsiębiorców, którzy pobierają zaliczki na podatek. We wniosku o subwencję mieli wskazać przychód ze sprzedaży, ale gdy tak robili, ich wniosek był automatycznie odrzucany.
Niektórzy więc zaczęli więc wpisywać dane z deklaracji VAT. Co prawda w ten sposób ograniczają sobie wysokość możliwej do uzyskania subwencji, ale nie pozbawiają się całkowicie prawa do niej.

Podstawą weryfikacji wniosków i oświadczeń wpływających na przyznanie subwencji i jej wysokość w ramach Tarczy Finansowej są rejestry publiczne Krajowej Administracji Skarbowej i Zakładu Ubezpieczeń Społecznych. Informacje o obrotach podatników VAT są weryfikowane na podstawie danych pochodzących z deklaracji VAT.

Problemu nie mają podatnicy, u których dane podawane dla celów VAT pokrywają się z danymi z podatkowej księgi przychodów i rozchodów albo ksiąg rachunkowych. Tak jest np. wtedy, gdy podatnik nie stosuje kasowej metody rozliczania VAT, tylko deklaruje przychód (dla celów podatku dochodowego) i obrót (dla celów VAT) na podstawie wystawionych faktur.

Podobnie jest, gdy podatnik nie pobiera zaliczek na podatek.

Problem z zaliczkami

Jest jednak cała grupa podatników, u których dane dla celów podatku dochodowego i VAT się nie pokrywają. Powodem są zaliczki.

Problem najlepiej zobrazować na przykładzie firmy, która odnotowała spadek przychodów ze sprzedaży, ale jednocześnie przyjęła zaliczkę na poczet przyszłych kontraktów.

Decyduje obrót z VAT

Dlatego – jak zaleca PFR – „wpisując obrót we wniosku, należy podać dane z określonych pól w deklaracji VAT”.
Informacje podawane przez podatników muszą być w prosty i szybki sposób weryfikowane. Stąd system weryfikuje je z deklaracjami VAT i z JPK_VAT.

Firmy, które chcą otrzymać subwencję, muszą podać dane, których wymaga od nich system. Trzeba więc bazować na danych z deklaracji VAT lub plików JPK_VAT, uwzględniając pola, które wskazało MF w komunikacie opublikowanym 28 kwietnia br. Z uwagi na wydłużone terminy do składania deklaracji rocznych PIT i CIT oraz sprawozdań finansowych system weryfikowania wniosków o subwencję z tarczy finansowej nie mógł mieć dostępu do tych informacji w momencie, gdy był projektowany. Nie ma i nie mógł mieć także dostępu do podatkowej księgi przychodów i rozchodów, ponieważ dane z niej nie są nigdzie składane. Jedyną informacją o obrocie są dla PFR deklaracje VAT-7 za miesiące od stycznia 2019 r. do grudnia 2019 r.

Jeżeli więc przedsiębiorca spotka się z odmową przyznania subwencji, to najprostszym i jedynym zarazem sposobem jest złożenie kolejnego wniosku uwzględniającego wartości wymagane przez system.

Metoda kasowa Problem z niespójnością przychodu (dla celów podatku dochodowego) i obrotu (dla celów VAT) dotyczy nie tylko zaliczek. Podobnie jest z VAT-owcami rozliczającymi się metodą kasową. W ich przypadku deklaracje VAT i pliki JPK_VAT nie odzwierciedlają faktycznych obrotów z danego miesiąca, tylko należności faktycznie opłacone. System automatycznie odrzuca więc wnioski, w których podają oni przychód memoriałowo, bo zaciąga informacje z dokumentów VAT-owskich.
